These Terms & Conditions ("Terms") govern your access to and use of the ColorPrompt.ai website, services, applications, content, and tools (the "Service"). By accessing or using the Service, creating an account, generating images, purchasing credits or memberships, or otherwise interacting with ColorPrompt.ai ("ColorPrompt," "we," "us," "our"), you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service.

1. Definitions

  • Generated Content: Any image, coloring page, illustration, design, or file created using the Service.

  • Credits: Units used to generate content. Different generation types require different credit amounts.

  • Bonus Credits: Additional monthly credits included with some memberships; bonus credits do not roll over.

  • Membership Credits: Monthly credits that renew with an active membership.

  • Pack Credits: Credits purchased through one-time credit packs.

  • Membership: A recurring paid subscription plan (Starter, Hobby, Artist).

  • Commercial Rights: Permission to sell products incorporating Generated Content, as defined in these Terms.

  • Active Membership: A paid membership that is current and not expired or canceled.

2. Use of the Service

You may use the Service only in compliance with these Terms and applicable laws. You agree not to misuse the Service or attempt to gain unauthorized access to systems, data, or content.

3. Credit System & Expiration Rules

3.1 Credit Consumption Order

Credits are always consumed in the following order:

  1. Pack Credits (One-Time Packs)

  2. Membership Credits (Monthly Credits)

  3. Bonus Credits

This order ensures credits with stricter expiration rules are used first.

3.2 Pack Credits (One-Time Purchases)

  • Pack credits are consumed before any other credits.

  • Pack credits do not expire as long as you generate at least one image every 90 days.

  • If no generation activity occurs for 90 consecutive days, all remaining pack credits expire permanently.

  • Pack credits do not grant commercial rights on their own.

  • Pack credits inherit the licensing rights of your current membership tier at the time of generation.

3.3 Membership Credits

  • Membership credits renew monthly while your membership is active.

  • Unused membership credits roll over for up to 30 days.

  • Credits older than 30 days expire permanently.

  • Rollover applies only while the membership remains active.

  • Membership credits are consumed after pack credits and before bonus credits.

3.4 Bonus Credits

  • Bonus credits are supplemental credits included with certain plans.

  • Bonus credits are consumed after pack credits and membership credits.

  • Bonus credits do not roll over and expire at the end of each billing cycle.

3.5 Failed Generations

If a generation fails due to a system or technical error, credits are automatically refunded to the appropriate credit bucket (pack → membership → bonus).

4. Membership Tiers & Licensing Rights

4.1 Starter Membership (Personal Use)

Starter Membership includes personal-use rights only.

You may:

  • Use images for personal, family, or educational projects.

  • Print images for personal or classroom use.

You may not:

  • Sell or distribute products containing the images.

  • Use images for commercial resale or paid services.

4.2 Hobby Membership (Personal & Classroom Use)

Hobby Membership includes personal and classroom use.

You may:

  • Use images for non-commercial projects.

  • Use images in educational or classroom settings.

You may not:

  • Sell products containing the images.

  • Use images for commercial resale or paid services.

4.3 Artist Membership — Limited Commercial License

While your Artist Membership is active, you receive a Limited Commercial License intended for individual creators, educators, and small businesses, not enterprise or corporate use.

Permitted Uses

You may:

  • Create and sell physical or digital products you personally make using Generated Content.

  • Sell coloring books, worksheets, printables, stickers, and merchandise.

  • Sell on platforms such as Etsy, KDP, TeachersPayTeachers, Shopify, and print-on-demand services.

  • Use images in marketing and branding for your own small business.

  • Modify, edit, and combine images as part of your products.

Duration of Rights

  • Commercial rights apply only to images generated while the Artist Membership is active.

  • If your Artist Membership expires, commercial rights end for future generations.

  • Rights for images generated during an active Artist Membership remain permanent.

Restrictions

Even with an Artist Membership, you may not:

  • Resell or redistribute raw images as standalone files or asset packs.

  • Sublicense images or grant usage rights to third parties.

  • Use images in enterprise-level, corporate, or mass-distribution contexts.

  • Use images in software, SaaS platforms, or datasets.

  • Train or build competing AI systems using Generated Content.

  • Claim Generated Content is hand-drawn or human-created.

This license is not an unlimited or enterprise commercial license.

4.4 Packs and Commercial Rights

  • Credit packs alone do not grant commercial rights.

  • Pack credits inherit the licensing rights of your current membership tier at the time of generation.

  • If your Artist Membership expires, pack-generated images created afterward revert to personal-use rights.

5. Billing, Cancellation & Refunds

5.1 Billing

Memberships are billed on a recurring monthly or annual basis using your payment method on file until canceled.

5.2 Cancellation

  • You may cancel your membership at any time from your account settings.

  • Cancellation stops future billing but does not refund the current billing period.

  • Membership benefits remain active until the end of the billing cycle.

5.3 Refund Policy — 7-Day Money-Back Guarantee

ColorPrompt offers a 7-day, no-questions-asked refund on new memberships and one-time credit packs.

Refunds are available if:

  • Requested within 7 days of purchase.

  • The purchase is a first-time purchase of that plan or pack.

Refunds do not apply to:

  • Renewals.

  • Upgrades or prorated changes.

  • Accounts exhibiting abusive or excessive usage.

Refunds revoke associated credits and membership access immediately and are issued to the original payment method.

6. Intellectual Property

  • You own the Generated Content according to your licensing tier.

  • ColorPrompt retains ownership of the Service, models, algorithms, and underlying technology.

  • Attribution ("Created with ColorPrompt.ai") is optional but appreciated.

7. Prohibited Uses

You may not use the Service to:

  • Generate illegal, hateful, explicit, or harmful content.

  • Infringe third-party intellectual property rights.

  • Automate, scrape, or abuse the Service.

  • Create or train competing AI systems.

  • Redistribute Generated Content as raw files for resale.

  • Engage in fraud or abuse refund policies.

8. Data & Privacy

Generated Content may be stored for your account history. Personal data is handled according to our Privacy Policy. You may request account deletion at any time.

9. Service Availability

The Service is provided "as is" and "as available." We do not guarantee uninterrupted access or permanent availability of features, styles, or content.

10. Termination

We may suspend or terminate accounts that violate these Terms, engage in abuse, or attempt fraud. Unused credits may be forfeited upon termination.

11. Changes to These Terms

We may update these Terms periodically. Continued use of the Service constitutes acceptance of updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
