Welcome to ColorPrompt.ai ("ColorPrompt", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of our website, tools, and services.

By accessing or using ColorPrompt.ai, you agree to these Terms. If you do not agree, you may not use the service.

1. Overview of the Service

ColorPrompt.ai provides tools that allow users to generate coloring pages and create custom printed coloring books using artificial intelligence.

Users may:

• Generate coloring pages
• Customize coloring books
• Order printed books
• Access features through paid subscriptions or credits

The service may change or evolve over time.

2. Accounts

To use certain features, you may be required to create an account.

You agree to:

• Provide accurate information
• Maintain the security of your account
• Be responsible for activity under your account

You must be at least 18 years old to create an account or make purchases.

3. Acceptable Use

You agree not to use the service for unlawful, abusive, or harmful purposes.

Prohibited uses include:

• Violating any laws or regulations
• Attempting to exploit or disrupt the platform
• Generating harmful, illegal, or abusive content
• Attempting to bypass system safeguards or protections

We reserve the right to suspend or terminate accounts that violate these rules.

4. User Content

Users may submit prompts, text, and images to generate coloring pages or books ("User Content").

You retain ownership of your User Content.

However, by submitting content you grant ColorPrompt.ai a non-exclusive license to process and generate outputs in order to provide the service.

You are responsible for ensuring your content complies with applicable laws and does not infringe third-party rights.

5. Generated Content

Content generated using the platform ("Generated Content") may be downloaded, printed, and used according to the rights granted under your plan.

However, ownership of Generated Content applies only to the extent the content does not infringe the rights of others.

ColorPrompt.ai does not guarantee that Generated Content will be free of similarities to existing works.

Users are responsible for reviewing generated content before using or distributing it.

5.1 User Content Privacy and Use by ColorPrompt.ai

ColorPrompt.ai does not claim ownership of your User Content or Generated Content.

We do not sell, license, or redistribute your personal photos or uploaded images to third parties.

We do not use your uploaded images or Generated Content for marketing, advertising, or public display without your explicit permission.

Your content is processed solely for the purpose of providing and improving the Service.

We may use anonymized and aggregated data to improve the platform, provided such data does not identify you or expose your content.

6. Definitions

Generated Content
Any image, coloring page, illustration, design, or file created using the Service.

Credits
Units used to generate content.

Bonus Credits
Credits included with memberships that expire each billing cycle.

Membership Credits
Monthly recurring credits.

Pack Credits
One-time purchased credits.

Membership
Subscription plan.

Commercial Rights
Permission to sell Generated Content under these Terms.

Active Membership
An active paid subscription.

7. Credit System & Expiration Rules

Credits are consumed in this order:

  1. Pack Credits
  2. Membership Credits
  3. Bonus Credits

Pack Credits expire after 90 days of inactivity and do not grant rights independently.

Membership Credits renew monthly and expire after 30 days.

Bonus Credits expire each billing cycle.

8. Membership Tiers & Licensing Rights

The rights granted to Generated Content depend on your active Membership at the time of generation.

8.1 Starter Membership (Personal Use Only)

Personal use only.

You may:

• Use images for personal, family, or educational purposes
• Print images for personal use

You may not:

• Sell or distribute Generated Content
• Use Generated Content commercially

8.2 Hobby Membership (Personal & Classroom Use)

Personal + classroom use only.

You may:

• Use Generated Content in educational environments
• Share within classrooms

You may not:

• Sell Generated Content
• Use commercially

8.3 Artist Membership (Limited Commercial License)

Limited commercial rights for small creators.

You may:

• Sell products you personally create
• Use content in small business marketing
• Sell on Etsy, KDP, Shopify, etc

You may not:

• Resell raw images
• License content to others
• Use in SaaS, datasets, or AI training
• Use at enterprise scale

Rights only apply to content generated while membership is active.

8.4 Packs

Pack credits do not grant rights independently.

Rights depend on membership at time of generation.

9. Pricing and Payments

Prices are listed in U.S. dollars unless otherwise stated.

Payments may be processed through third-party payment providers.

We reserve the right to change prices at any time. Price changes do not affect completed purchases.

10. Subscriptions

Some features are available through paid subscriptions.

Monthly Plans

Monthly subscriptions renew automatically until canceled.

Annual Plans

Annual subscriptions are billed upfront for the full term.

Unless otherwise stated:

• Subscription payments are generally non-refundable
• Downgrades apply at the next billing cycle

11. Intellectual Property Restrictions

Users may not use the service to generate, upload, print, distribute, or sell content that infringes the intellectual property rights of others.

Prohibited content includes, but is not limited to:

• Copyrighted characters or franchises
• Trademarked brands or logos
• Characters from movies, television, books, games, or other media
• Derivative works of protected intellectual property

Examples include characters owned by major entertainment studios, media companies, or gaming publishers.

ColorPrompt.ai does not grant rights to reproduce or create derivative works of third-party intellectual property.

12. Automated Intellectual Property Safeguards

ColorPrompt.ai implements automated safeguards designed to discourage or block prompts that appear to request copyrighted characters, trademarked brands, or other protected intellectual property.

These safeguards may include automated filtering of prompts referencing well-known characters, brands, or franchises.

However, automated systems are not perfect and ColorPrompt.ai cannot guarantee that all generated content will be free of similarities to existing works.

Users remain solely responsible for ensuring their prompts and generated content do not infringe the rights of third parties.

13. Order Review and Refusal

ColorPrompt.ai reserves the right to review generated content or printed orders.

We may refuse to generate, print, or fulfill any order that appears to contain:

• Copyrighted characters
• Trademarked brands
• Illegal or prohibited content
• Content that violates these Terms

Orders refused for these reasons may be canceled and refunded at our discretion.

14. Custom Printed Products

ColorPrompt.ai offers custom printed coloring books created from user-generated content.

Because these products are printed on demand:

• Orders cannot be modified once production begins
• Returns are not accepted except in cases of defects
• Printed books are considered custom products

Refunds or replacements are handled according to our Refund Policy.

15. Refund Policy

Refunds and replacements are governed by our Refund Policy available at:

That policy forms part of these Terms.

16. Intellectual Property Ownership

The ColorPrompt.ai platform, including:

• Software
• Design
• Algorithms
• AI models
• Branding

are owned by ColorPrompt.ai and protected by intellectual property laws.

You may not copy, reproduce, or distribute the platform without permission.

17. AI Output Disclaimer

Artificial intelligence systems may generate outputs that resemble existing works.

ColorPrompt.ai makes no representation or warranty that generated content will be unique or free from similarities to existing copyrighted material.

Users are responsible for ensuring their use of generated content complies with applicable laws.

18. Limitation of Liability

To the fullest extent permitted by law, ColorPrompt.ai shall not be liable for indirect, incidental, or consequential damages resulting from use of the service.

Our total liability related to any claim shall not exceed the amount paid by the user for the relevant order or service.

19. Indemnification

You agree to indemnify and hold harmless ColorPrompt.ai, its owners, employees, and affiliates from any claims, damages, or liabilities arising from:

• Your use of the service
• Content you generate or upload
• Violations of intellectual property rights
• Violations of these Terms

20. Termination

We reserve the right to suspend or terminate accounts that violate these Terms or misuse the platform.

21. Changes to These Terms

We may update these Terms periodically.

If we make significant changes, we will update the "Last updated" date at the top of this page.

Continued use of the service constitutes acceptance of the updated Terms.

22. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California.

All disputes shall be resolved exclusively in California courts.
